Did you know on average there are two on the spot fines handed to business just like yours every single day!

A single penalty can extend to $63,000.

Many breaches are simple oversights such as bookkeeping and pay slips..

To build your business armoury, The Chambers have designed Workplace Assured to simply help employers like you worry less about workplace relations risks (and the Ombudsman!) and focus more on your business, because we believe that businesses are the backbone of the Australian community.

In the report, the Ombudsman stated:

‘Our litigation program has seen us initiate increasingly complex litigations, involving more complainants and a wider range of contraventions. This has contributed to a progressive rise in penalties awarded over the last three years.'

Audits doubled the recovery of monies

Migrant workers make up 6% of the Australian workforce yet 18% of all workplace disputes involved a visa holder!

Over 10,000 tip offs were made with half of these reports relating to non-compliance in hospitality and retail industries.

Audits revealed compliance rates down 8% to the previous year and recovered $5.5m in unpaid wages, up 213%!

“The maximum penalty for breaching your obligations under the Fair Work Act is now $63,000 per breach, even the smallest oversight could end up costing you dearly.”

Ben Foley, Workplace Assured

"If you employ a lot of migrants or young people, you're probably going to be on the radar of the ombudsman, in terms of enforcement strategy.”

"Once the Ombudsman gets involved they really do start to look right down at the basic things - I call it the Ombudsman shopping list and they get down to things like, have you provided a fair work information statement? And were you late in providing pay slips?”

Total penalties up 66% from previous year

In 2016-17, the Ombudsman ordered $4,864,925 in penalties to be paid by employers who breached legislation. Compared to the $2,918,643 in 2015-16.

Wages the #1 topic for enquiries

Wages was the most common reason people called. Making up 10-15% of all calls for all industries. This was followed by entitlements and termination.

'On-the-spot' penalties up 10% from 2015

Infringement notices for record keeping and payslips increased to 665 for 2016-17. The Ombudsman is cracking down on poor record keeping!
